This document establishes the General Terms and Conditions of Contract for the website www.mumit.com, which is intended for the sale and purchase of products from Mumit Jewellery, S.L. (hereinafter, the Owner), with NIF B-16836553 and address located at Calle Ramón Cabanillas, Number, 11, Level 8 - 32003 Ourense, registered in the Mercantile Register of Ourense, Volume 932, Book 0, Folio 161, Page OR-17473 by individuals and/or legal entities (hereinafter, the Contracting Party) who express their desire to purchase the products that are made available on the website www.mumit.com, by means of a request made by electronic means - specifically, via the Internet - through this website owned by the Owner.

 

1. PRE-CONTRACT INFORMATION, AVAILABILITY OF CONTRACTING CONDITIONS, CONTRACTING PARTY'S ACCEPTANCE, POST-CONTRACT DOCUMENTATION AND INFORMATION

 

These General Conditions of Sale and Purchase are permanently displayed on the website www.mumit.com, owned by the Owner, and all users may file them, print them and, therefore, be previously informed of the conditions of the price, characteristics, rights and, in general, of all the conditions under which the sale and purchase will take place.

Likewise, these General Conditions are reiterated together with a summary of the specific request - specific product contracted, cost with indication of taxes if applicable, shipping costs etc. - for express acceptance by the Contracting Party - by clicking "I read and accept the conditions" - each time a specific request for products is made through the website. The Contracting Party will have a secure area to which he/she will have access with a username and password, which is where the purchase is completed and where he/she can track his/her orders.

It is not technically possible for the Contracting Party to complete the application without acceptance of these General Terms and Conditions. In order for the Contracting Party to be able to make this acceptance and, therefore, to place the order, he/she must fill in a form with his/her basic data where he/she places the specific order, by which he/she accepts these Conditions.

By accepting these conditions, the Contracting Party gives his express and unreserved consent for the Owner to carry out the necessary payment operations for the acquisition of the products he has contracted, expressly authorising Mumit Jewellery, S.L. to make the payments using the payment methods he has selected and/or entered from the secure area, enabled for this purpose, in accordance with Law 16/2009, of 13 November, on payment services.

These General Terms and Conditions together with the specific request made by the Contracting Party via the Internet - particular terms and conditions - imply the formalisation of the purchase contract between the Owner and the Contracting Party who declares to be of legal age, to have sufficient capacity to contract and to have read, understood and accepted these terms and conditions.

The Owner, at the time of contracting and within a period not exceeding twenty-four hours, shall send to the e-mail address specified by the Contracting Party in the registration form as the main means of contact: confirmation of the contracted product, cost, with a breakdown of taxes if applicable, as well as the shipping costs if necessary. Any subsequent changes to these General Terms and Conditions shall be notified to the Contracting Party by e-mail one month in advance and shall be clearly displayed in an easily accessible place on the website www.mumit.com. All the aforementioned documentation may be printed and filed by the Contracting Party and may be requested at any time by Customer Service via email sent to hola@mumit.com, by telephone at (+34) 604 00 21 21 or by Whatsapp at (+34) 604 05 05 05 05.

Any request for information, or complaint that is considered relevant, may be made to the Customer Service Department at the addresses identified in the previous paragraph.

 

2. OBJECT OF THE CONTRACT

 

The Owner hereby undertakes to deliver to the Contracting Party the products ordered by the latter through the website www.mumit.com in exchange for a certain price and in accordance with the conditions set out below.

 

3. RIGHTS AND OBLIGATIONS OF THE OWNER

 

3.1. Delivery of the product. The Owner undertakes to deliver the product in perfect condition, within 2 to 15 working days, to the address indicated by the Contracting Party on the order form containing the specific conditions attached to these general terms and conditions. The Owner shall not be liable for any errors caused in the delivery when the data entered by the Contracting Party in the order form does not correspond to reality or has been omitted.

3.2. Owner's liability. The Owner shall in no event be liable in connection with:

3.2.1. Errors, delays in access by the Contracting Party when entering their data in the order form, the slowness or impossibility of confirming the order or any anomaly that may arise when these incidents are due to problems in the Internet network, fortuitous events or force majeure and any other unforeseeable contingency beyond the good faith of the Owner. In any case, the Owner undertakes to solve any problems that may arise and to offer all the necessary support to the Renter in order to reach a quick and satisfactory solution to the incident.

3.2.2. Errors or damages caused by inefficient and bad faith use of the service by the Contracting Party.

3.2.3. The inoperability of the e-mail address provided by the Contracting Party for the sending of the order confirmation.

3.2.4. The Owner shall be fully responsible for the quality of the products and shall be entitled to return them if they are defective or if they do not reach the Contracting Party in proper condition. The Contracting Party must make the claim for the refund through the website itself in its specific section in order to be able to effectively follow up the incident. In this case, the Owner shall bear the costs incurred as a result of such return, provided that the Renter notifies this fact within seven days from the date of delivery and the product has not been consumed or altered in any way. The Owner is exempt from any liability in relation to possible breakages or defects of the product occurring after the delivery of the product, and the Owner shall have no liability in relation to those products that have already been consumed or used without any incident on the part of the Contracting Party who intends to make a claim. The Contracting Party, before signing for the delivery of the order, must check that the product is delivered in perfect condition. If the Contracting Party agrees at the time of delivery, it is understood by both parties that the product was delivered correctly and that, therefore, any possible deterioration occurs after delivery.

3.2.5. The Employer expressly waives any contractual or non-contractual liability for any damages arising from the foregoing in this clause. In any case, the Owner's liability in the event of breach of this agreement in accordance with the terms of these general terms and conditions shall be limited to the refund of any amount that may have been paid by the Contracting Party, provided that the product in question has been returned by the Contracting Party.

 

4. RETURNS

 

4.1. RIGHT OF WITHDRAWAL: The customer will have a maximum of 14 calendar days from receipt of the order to process its return, in accordance with the applicable legislation. Once these 14 days have elapsed, Mumit Jewellery, S.L. will not accept the refund.

In order to process a return, the user must contact Mumit Jewellery, S.L. by sending an email to hola@mumit.com, from where the necessary steps will be taken, under the following conditions:

  • The product must be returned in its original packaging and condition, including proof of purchase and the delivery note of the product, as well as the reason for the return.
  • The return should be sent to the following address: C/ Valle Inclán, Nº 6, 1ª Planta, Ourense. C.P. 32004

 

4.2. RIGHT TO DEFECTIVE PRODUCTS: If the product is not in optimum condition and/or has a defect, it may be returned within a maximum period of 15 calendar days from receipt of the order, and we will proceed to replace it. The user shall have the right to claim, and be delivered, an equal product, in perfect condition. In the event that the product is not available, the company will proceed to refund the amount paid by the customer, including shipping costs, according to the payment method used in the purchase.

In the specific case of defective products, or products that do not match the order placed by the customer, the customer shall not be liable for the cost of returning such products.

4.3. REFUND: Provided that the user has complied with the aforementioned conditions, Mumit Jewellery, S.L. will reimburse the price paid by the user for the products returned. In case of return due to withdrawal, Mumit Jewellery, S.L. will not pay the shipping costs associated with the return of the product.

In case of non-compliance with the requirements included in these General Terms and Conditions, the user shall not be entitled to any refund.

In the case of a partial return, the user will be reimbursed the corresponding amount for the products returned.

Mumit Jewellery, S.L. will proceed to refund the order by means of the same payment method used by the user for the purchase, within 14 calendar days after the withdrawal is exercised, being essential the collection of the product and after the pertinent verification of the state of the product.

 

5. RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTY

 

 

5.1. Payment. The Contracting Party undertakes to pay the amount for the product actually ordered in the following amount and form:

5.1.1. Amount. The remuneration for the product actually ordered by the Contracting Party shall be that indicated on the website and that which appears in the Contracting Party's specific request at any given time, such requests constituting the particular conditions of the specific order. The prices of the products that appear on the website are always inclusive of taxes.

In addition to the price shown on the website for each of the products offered, the relevant shipping costs must be added to the price shown on the website. As these rates are never applied by the Owner, it is necessary to bear in mind that they will always be those officially offered by the transport company and that the Owner will not make any profit from these rates by communicating the overall cost of the product and the shipping costs, which are always broken down in advance to the Contracting Party before confirmation of the purchase request by the latter. These rates will depend on the volume and weight of the products purchased.

5.1.2. Methods of payment. The Contracting Party must pay the amount corresponding to the contracted product using the payment methods available on the website. They are as follows: Paypal, bank transfer, credit or debit card, Apple and Google Pay and financing through Aplazame.

5.2. Withdrawal. The products offered on www.mumit.com allow the right of withdrawal within a maximum period of 14 calendar days after the customer exercises the right of withdrawal. In order to be able to return the product, it is essential to have received the order and that the product is returned in the same condition in which it was delivered, with the cost of return being borne by the Contracting Party - see clause 3.2.4 - unless the product has been delivered in poor condition or deteriorated.

5.3. Liability of the Employer. In any case, it shall be the Employer's responsibility:

5.3.1. The Renter assumes all risks of deterioration, deterioration, damage and loss of the products from the moment they have been placed at his disposal by the third party who, on behalf of the Owner, delivers the ordered products.

5.3.2. The Renter undertakes to check that the product is in good condition with the third party who, on behalf of the Owner, delivers the product ordered, and to do so before signing the proof of delivery. 

 

6. CANCELLATION OF THE CONTRACT

 

The Owner and the Renter may terminate this contract for any of the causes established by law and in particular for breach of these General Terms and Conditions. Cancellation is also possible as indicated in clause 4.2. of these general terms and conditions.

 

7. COPYRIGHT AND TRADEMARK

 

The Owner informs that the contents, programming and design of the website www.mumit.com, are fully protected by copyright, and any reproduction, communication, distribution and transformation of the aforementioned protected elements is expressly prohibited without the express consent of the Owner. The Owner uses external sources for the preparation of its articles on certain occasions and also establishes links or hyperlinks to articles or information from third parties, always quoting the source. The legitimate owner of the copyright of this information may at any time request the removal of such references. The trademarks and copyrights of the products that the Owner sells through the website belong to their rightful owners.

 

8. JURISDICTION AND APPLICABLE LAW

 

These general conditions are governed by Spanish law. The Courts of Ourense are competent to resolve any dispute or conflict arising from these general conditions, and the Contracting Party expressly waives any other jurisdiction that may correspond to it.

 

9. OTHER

 

In the event that any provision of this document is declared invalid, the remaining provisions shall remain in force and shall be interpreted taking into account the will of the parties and the purpose of these terms and conditions. The Owner may not exercise any of the rights and powers conferred in this document, which shall in no case imply the waiver of the same unless expressly acknowledged by the Owner.
